Closing in Rutherford County
Maybe the house sits on a county road between two towns, with a few acres you hope to divide some day. Maybe you are the seller, and you bought before values were last reset. Either way, the contract on the table is the statewide Tennessee REALTORS form, and it has no idea which side of a city line the land is on. The county does, and outside the city limits it decides what a tract may become, who taxes it and what may be built on it. Start with the land, because outside Murfreesboro, Smyrna, La Vergne and Eagleville the county's Planning and Engineering office at 1 Public Square South sets the rules for dividing it. A new lot under five acres needs a subdivision plat drawn by a registered surveyor or engineer. Staff can approve one or two lots that meet the minimums - lot size, water, 75 feet on the road and a soil site - while three or more lots, or any lot that falls short, go before the Planning Commission. At five acres and up, a tract can be carved out by deed alone if it has water and 50 feet of road frontage, but nobody builds on it without a soil site. If the price you are paying counts on a second homesite, write the contract so it waits on the plat. Permits come in a set order too: the septic map or permit from the state environmental office in the same building first (a lot on STEP or city sewer skips that step), then a Certificate of Zoning Compliance, then Building Codes. And here is the part buyers miss. The county calls private covenants a civil matter it will not consider or enforce. So the restrictions on your lot still bind you, and when the lot next door breaks them, enforcing them is a private matter - the county will not step in. Get the recorded restrictions, read them before you sign, and find out who, if anyone, actually enforces them. ‡‡
Outside town, water most often comes from the Consolidated Utility District, and where a subdivision has no sewer line, wastewater may go to a CUD STEP system, and that divides the job on your own lot: CUD owns the green-topped risers and the pipes and answers an alarm on the outside control panel, while a backup that never trips the alarm is usually the owner's plumbing. Ask which system the house has before the inspection, not after. A new house carries one more county charge, inside the cities as well as out. The School Facilities Tax took the place of the Development Tax in July 2021, is figured by the square foot on new homes and additions, and since October 1, 2024 has been due when the building is finished, before the certificate of occupancy. Whichever corner of the county the deed comes from, it is recorded at one counter: the Register of Deeds, Room 133 at 319 North Maple Street in Murfreesboro, which takes electronic filings and collects the state's transfer and mortgage taxes as documents go on record. The Register's own website is plain about its limits. The staff is not licensed or bonded to search titles, never guarantees that a deed is clear, and tells the public to get a thorough search from someone who is. Recording proves a paper was filed, not that the title behind it is sound, and whoever checks that on your closing should be working for you. Property tax can mean more than one bill and more than one office. The Trustee collects the county's tax from Room 102 of the Historic Courthouse and from a branch at 205 I Street in Smyrna. Each bill covers the calendar year, is due the first Monday in October and can be paid without interest through the last day of February; after that, an unpaid balance grows 1.5 percent a month. Smyrna and Eagleville put their city tax on the county's bill, Murfreesboro and La Vergne bill separately, and land in no city gets the county bill alone. Older unpaid years live somewhere else again: the Chancery Court's Clerk and Master collects delinquent taxes for the county and for Murfreesboro, La Vergne and Smyrna. A clean answer from one office does not speak for the others. Selling? This fall's bill is also the first one figured on new values. The Property Assessor revalues the whole county every four years, and 2026 is that year. In June the Assessor reported that the county's appraised market value had climbed from 52.5 billion dollars to 81.7 billion, and certified rates were set for the county and its four cities. A certified rate is a starting point, not a forecast for your house: a property whose value rose faster than most can still owe more. So check the bill, not the rate. The standard contract prorates the year's taxes at closing and falls back on last year's rate when this year's is not set, so on a 2026 closing, compare the proration with the bill that actually arrived. ‡‡‡
Cities and towns in Rutherford County
Murfreesboro
The county seat, where every office on this page keeps its counter. Inside the city, Murfreesboro City Schools runs the elementary grades and City Hall sends its own tax bill; the Murfreesboro guide carries the rest.
Smyrna
Town tax comes on the county bill, and the Trustee's I Street branch takes payment in person. Older unpaid town taxes are collected by the Clerk and Master, not by the town.
La Vergne
The city bills its tax separately from the county's. Its ZIP, 37086, reaches into Davidson County, so check which county's Register holds the deed before you trust the mailing address.
Eagleville
City tax rides on the county bill here. ZIP 37060 runs into Williamson, Bedford and Marshall counties, and the County Clerk keeps hours at Eagleville City Hall on the first working day of each week.
Rockvale
With no city government, the county's zoning, its permit order and the single county tax bill all apply. Part of ZIP 37153 is in Bedford County, where a different Register keeps the deeds.
Christiana
Unincorporated farm country south of Murfreesboro, where the county's land-split and soil-site rules decide what a tract can become. Ask for the plat history before you pay for a homesite that does not exist yet.
Lascassas
An unincorporated community northeast of Murfreesboro, ZIP 37085, with a county elementary school for pre-K through fifth grade. Part of the ZIP lies in Wilson County, so look up the parcel before you assume the deed records in Murfreesboro.
Milton
Unincorporated, in the county's northeast corner along State Route 96. Its ZIP, 37118, also reaches into Cannon and Wilson counties - the county line, not the mailing address, decides whose offices you deal with.
Readyville
Mostly in Cannon County, partly in Rutherford, all under ZIP 37149. A Readyville listing can sit on either side of the line, and the side sets the Register, the Trustee and the zoning office.

When are property taxes due in Rutherford County, TN?
The Trustee's bill is due the first Monday in October and can be paid without interest through the last day of February; from March on, an unpaid balance adds 1.5 percent a month. Smyrna and Eagleville city tax rides on that same bill, while Murfreesboro and La Vergne send their own. Does the Rutherford County Register of Deeds do a title search?
No. The Register, on North Maple Street in Murfreesboro, records every deed in the county, but the office says it is not licensed or bonded to search titles and never guarantees a deed is clear. The search comes from whoever closes your purchase. The Tennessee REALTORS contract gives each side its own line to name a closing agency, so you can write in Vanderpool Law and have your own lawyer do it. ‡‡
How do I split land in unincorporated Rutherford County?
Through the county's Planning and Engineering office. Under five acres, each new lot needs a subdivision plat from a registered surveyor or engineer; staff can approve one or two lots that meet the minimums, and anything larger goes to the Planning Commission. Five acres or more can be divided by deed with water access and 50 feet on the road, and a soil site is still needed before anyone builds. If the split is the reason you are buying, make the contract depend on it. ‡
Does Rutherford County enforce subdivision covenants and deed restrictions?
No. The county's planners call covenants a civil matter they cannot consider or enforce, so a restriction is only as strong as the association or the neighbors willing to act on it. Read the recorded restrictions before you sign, and ask Vanderpool Law to go through them with the contract - all you have to do is ask. ‡
How will the 2026 Rutherford County reappraisal affect my property taxes?
The house's value has been reset for 2026, while the seller's last bill was figured on the 2022 one. Certified rates came out in June, but a property that gained more than most can still owe more, so check the 2026 bill itself before you agree to the proration. If the value looks wrong, start with the Assessor's office; the Board of Equalization comes next. ‡‡
What school district is my Rutherford County address in?
Usually Rutherford County Schools, which opened its 53rd school, Poplar Hill Middle in Blackman, this year. Inside Murfreesboro, Murfreesboro City Schools runs the elementary grades. The county board redrew elementary and middle school zones in December 2025, so a listing written before then may name the wrong school. Put the street address into the district's zone lookup before you sign. ‡‡‡‡
Do I need a fence permit in unincorporated Rutherford County?
Not according to the county planners. The fence still has to stay off a neighbor's land and out of the county right-of-way, and it cannot block the view at a driveway or an intersection. Get a survey that shows the lines before the posts go in, and on a STEP lot keep clear of the utility's equipment. ‡‡
Selling an inherited house in Rutherford County: which court handles probate?
The county's Probate Court - the General Sessions judges, sitting as probate judge under a private act - with the papers filed at the County Clerk on North Maple Street. The small-estate shortcut is closed to an estate that owns real property, though the Clerk's fee schedule does list a muniment of title for real estate. Before you list, ask Vanderpool Law to look at the estate papers so the authority to sign the deed is settled first. ‡‡
