Maybe you saw the house on a Saturday and signed on Sunday, or maybe the agent's draft is still waiting in your email. Either way, the purchase agreement is a statewide form, and it knows nothing about this particular address: whether the town actually reaches it, whether a creek behind it shows up on a federal flood map, whether the airport's height rules cover it. Begin with the envelope. 37167 is the Smyrna mailing ZIP, but when the Census Bureau laid ZIP areas over town boundaries in 2020, much of the 37167 ZIP lay outside the town - nearly all of that in unincorporated Rutherford County, with a sliver in La Vergne. Which side of the line the house is on decides who taxes it, whose zoning rules it and who runs the pipes. Inside the town, Smyrna Utilities provides water, sewer and natural gas, and the town's 2021 plan says its water lines stay mostly within the town limits; outside, the water may come from the Consolidated Utility District of Rutherford County. Middle Tennessee Electric counts Smyrna among the places it serves. So do not take the mailing address at its word. Then look behind the house. The town's comprehensive plan, adopted in December 2021, lists West Fork Stones River, Stewarts Creek and Harts Branch as streams that FEMA's flood insurance rate maps show with flooding hazards inside Smyrna, and it says stretches of Sam Ridley Parkway, Rock Springs Road and Mapleview are subject to flooding. That matters to the offer, not just to the yard: if the house is in a zone whose name starts with A and the loan is federally backed, the lender will make flood insurance a condition. Type the address into FEMA's Flood Map Service Center and get a premium quote before you settle on a price, because once the appraisal is in, that number has nowhere to go but your monthly payment. And if you plan to build, or to bring in fill, on floodplain ground, the town's Floodplain Administrator has to issue a development permit first. ‡‡‡

Living near Smyrna Airport is about more than the sound of the planes. The field covers more than 1,700 acres and calls itself the busiest general aviation airport in Tennessee, and the Smyrna/Rutherford County Airport Height Zoning Ordinance, carried in the town's zoning ordinance, limits how tall buildings and even trees may grow inside its zones. It also forbids uses that create glare, lights a pilot could mistake, or a bird-strike hazard, and it points to avigation easements on record in Deed Book 208, Page 145. Buying close to the field? Go through the exceptions in the title commitment one at a time, and before you count on a second story, a tall antenna or a screen of trees, find out whether a height limit says otherwise. ‡‡

A brand-new house, or a resale with a bonus room someone finished later, raises a different question: was the work permitted? The town's Building Safety Department issues a Certificate of Occupancy only after a new structure passes inspection. It wants a site plan and a permit for a deck, porch, garage, pool or addition, and it inspects before an attic or garage is turned into living space. On new construction, ask for the Certificate of Occupancy, and ask whether a Notice of Completion has been recorded - Tennessee uses that notice to shorten the time contractors and suppliers have to claim a lien. On a resale, ask whether the converted garage or the bonus room had a permit. If it did not, you pay for the room now, and you answer for it later, when your own buyer asks you the same thing. ‡‡ What title insurance covers, and what it does not →

Selling? There is one Smyrna item worth clearing early. The town files property maintenance liens, and they are paid through the Rutherford County Trustee - but paying is only half of it. After payment, the owner has to contact the town to arrange the release, and the town itself warns that otherwise the lien may not be timely and properly released. A lien still showing on the record at closing is your buyer's problem until it becomes yours. If you know of one, or even suspect one, tell Vanderpool Law when you list, so the payoff and the release are both done before anyone sits down at the table. ‡

When the papers are signed, the deed goes to Murfreesboro, the county seat. The Rutherford County Register of Deeds, Heather Dawbarn, records it at 319 North Maple Street and collects the state transfer tax - 37 cents per 100 dollars of the price or the value, whichever is higher - and the mortgage tax on a new loan, 11.5 cents per 100 dollars, with the first 2,000 dollars of the loan exempt. The Register's own site is blunt that the office does not do title searches: it records what it is handed and does not vouch that the title is clean. That checking is somebody else's job, and on your closing it should be your own lawyer's. The site also points owners to an alert service that flags new filings against their name. The neighborhoods of Smyrna

Old Downtown and the Front Street Historic District

The old railroad town, grown from lots sold around the depot, sits under the town's H-1 Historic Overlay. There, building, altering, moving or tearing down needs the Historic Zoning Commission's review under the Front Street guidelines before a permit issues - so if the house comes with renovation plans, learn the rules before you sign, not when the contractor calls.

Around Smyrna Airport

Land around the old Sewart Air Force Base sits inside the airport's height zones, with avigation easements on record. Find out how high you may build, or let a tree grow, before your plans for the lot depend on the answer.

Nissan Drive corridor

Nissan has built cars in Smyrna since 1983 and employs about 8,400 people, and the town's plan calls this stretch, across from the plant, ground zero for its largest employer. If the job is why you are moving, you probably read the offer letter twice. Give the purchase agreement the same care.

Stewarts Creek

Stewarts Creek Elementary and Stewarts Creek High both sit on Red Hawk Parkway, and the creek is one of the streams on FEMA's flood maps. The elementary school's zone was redrawn for 2026-2027, so look up both the flood map and the school map by the exact street address.

Toward Percy Priest Lake

Parts of the lake lie inside the town limits, and the land around it is public, run by the Army Corps of Engineers - so if a listing makes the water sound like part of the lot, have the survey show where the lot actually ends.

Rock Springs Road

A long residential road north of the center, with Rock Springs schools along it, and one of the corridors the 2021 plan says floods in places. Pull the flood map for the lot you are buying, not for the road it is on.

Jefferson Pike and the I-840 edge

The 2021 plan shows the town's water mains reaching along Jefferson Pike into the Urban Growth Boundary - land outside the limits today that could be annexed later - and calls for a sewer extension along the pike. Ask whether the lot is in the town now, and whether the house is on sewer or something else.

Rutherford County, and its seat is Murfreesboro. That is where a Smyrna deed is recorded, at the Register of Deeds on North Maple Street, and where the Trustee's main office collects property tax; the Trustee also keeps a Smyrna office at 205 I Street. For a buyer, though, the county line is the easy part. The line that changes your tax bill, your utilities and your zoning is the town line. ‡‡

Is every Smyrna, TN address inside the town limits?

No. When the Census Bureau matched ZIP areas to town boundaries in 2020, much of ZIP 37167 lay outside the town, in unincorporated Rutherford County. Inside the town, the Town of Smyrna's property tax comes on the same bill as the county's and the town's zoning applies; outside, neither does. Before you sign, look up the parcel's tax record rather than trusting the mailing address in the listing. ‡‡

When are Smyrna property taxes due, and how are they split at closing?

Inside the town limits, the Rutherford County Trustee bills town and county tax together. The bill is due the first Monday in October and can be paid without interest through the last day of February; after that, interest runs at 1.5% a month. Each bill covers January 1 through December 31, and the Tennessee REALTORS contract divides the year's taxes as of the closing date. Closing in the fall? The question to ask is who has already paid the bill that just came. ‡‡‡

Selling a house with a lien in Smyrna, TN: what has to happen before closing?

Each lien has to be paid off and released, or your buyer does not get clear title. Sellers often forget one kind: the Town of Smyrna's property maintenance lien. It is paid through the County Trustee, and then the owner has to contact the town to have it released - the town warns that without that call the lien may not be properly released. Can I use a Smyrna, TN house as a short-term rental?

Not inside the town limits. The town does not allow a single detached house, or any part of it, to be rented for less than three months, and it can cite an owner after notice. If rental income is part of the math, settle this before you sign - and check whether the address is inside the town in the first place. ‡‡

Can I sell an inherited house in Smyrna, TN without probate?

Not through the shortcut. Rutherford County's small-estate procedure is closed to estates that own real property, so an estate with a house goes to the Probate Court, where the General Sessions judges sit as probate judges and the County Clerk keeps the file.
