Closing in Sumner County
Maybe the listing said Portland, or Hendersonville, or gave only a rural route out toward Bethpage. Whichever it was, the purchase contract will be the same Tennessee form, and it will not tell you the one thing that sorts out everything else: who governs the lot. Inside one of the eight cities and towns, that city does. Outside them, the county planning office in Gallatin does, and behind some lakefront yards the federal government has its own say. Zoning, permits, septic, taxes and any dock all follow from that answer, so get it while the contract is unsigned and changing course is still easy.
Past the city limits there is no town hall to call; the county is the local government. Its Planning and Engineering Department serves about 60,000 people over more than 400 square miles of unincorporated land, and every new-construction application out there is checked against the county's zoning resolution and map. Do not assume you know which side of a line a house sits on. When the county surveyed residents for its 2025 land-use plan update, 118 of the 3,973 who answered said they were not sure whether they lived in a city or the county. Pull the parcel up in the county property search before you make an offer, and if the land matters for what you mean to build, ask county planning for a zoning determination letter on it before your signature turns the plan into a promise. ‡‡‡‡‡
Country land raises two questions a subdivision house rarely does: can you build on it, and can you divide it? The county's subdivision regulations treat any split into pieces under five acres, for sale or for building, as a subdivision, and every new lot must run along a public street for at least 50 feet. A recorded easement does not satisfy that. A lot already on record that reaches the road over an easement keeps its access, but only one tract may use the easement, and tracts of five acres or more fall outside the rule. If the property sits at the end of a shared gravel lane, or you hope to deed a piece of it to a son or daughter someday, put the question to the planning office before you sign. And count on a separate permit from the County Highway Department for any new driveway onto a county road. ‡‡
Out here, septic is a state matter. The county's Building and Codes office sends septic permit applications to the Tennessee Department of Environment and Conservation, and the subdivision rules want every lot to hold its own approved system, never one sitting on a neighbor's land by easement. A shared treatment system, such as a STEP system, has to belong to an owner the Planning Commission approves. Then look at the recorded plat for a star on the lot. A star means the lot is critical, usually because of a slope steeper than 15 percent or a soil, flooding or sinkhole concern, and construction waits until the County Engineer approves a plan. Ask the seller for the septic permit and any repair records, read the plat yourself, and if the lot is near a FEMA flood zone, expect county floodplain staff to review whatever you build there. ‡‡‡‡‡
Two papers on record at the Register can change what a country place is worth to you, and a listing will mention neither. One is greenbelt. Farm, forest and open-space land is taxed on its use, and the owner records the approved application with the Register. When the land is sold and put to another use, or a subdivision plat goes on record without the farming carrying on, or it stops qualifying some other way, rollback taxes come due on the next tax roll: three years of the savings for farm and forest land, five for open space. Decide in the contract who pays them. The other is a guest-house covenant. In the unincorporated county an accessory dwelling is allowed only after the owner records one: the owner lives in one of the two units, and the other is for family or guests and may not be rented or leased. Counting on rent from the cottage out back? Read that covenant before you are bound to buy. ‡‡‡
Where county land runs down to Old Hickory Lake, the Corps of Engineers' 2020 shoreline plan applies whether the lot is inside a city or out in the county, and two of its rules catch buyers of rural and new-subdivision lots. No new septic tank, drain field or holding tank may go on Corps land, so on a lakefront lot without sewer the system has to fit on your own side of the government line. And no individual dock goes beside a subdivision's common area. Under the plan, a community dock there is issued only to a non-profit corporation, only after a quarter of the homes are owner-occupied, with officers who actually live there, and never with more slips than there are lots next to the common area. If a slip is part of what a lake community is selling you, ask to see the Corps permit for that dock before you sign. Cities and towns in Sumner County
Gallatin
The county seat. The Register, the Trustee and county planning all work out of the administration building on North Belvedere Drive. Inside the city limits, Gallatin's own zoning and tax bill take over from the county's planning rules, and the Gallatin page carries the rest.
Hendersonville
A lake city of 64,266 by the Census Bureau's 2025 estimate. Its waterfront is Corps of Engineers shoreline, so a lakefront buyer there starts with the Corps' rules, and the Hendersonville page walks through them.
Goodlettsville
Split between Davidson and Sumner, with 6,286 residents on the Sumner side by the 2025 estimate. The county the parcel sits in decides which Register records your deed, so look it up before closing.
White House
Part Sumner, part Robertson, with 9,032 residents on the Sumner side by the 2025 estimate. If the lot is on the Robertson side, the White House page covers what changes.
Portland
13,614 residents in Sumner and 44 across the Robertson line by the 2025 estimate. The 37148 ZIP code also covers Mitchellville and, in Robertson County, the city of Orlinda, so the ZIP alone will not tell you the county. Portland supplies its own water, sewer and natural gas; set up the transfer with the city before closing day.
Millersville
A city in two counties: 5,057 residents on the Sumner side and 1,381 in Robertson by the 2025 estimate. Read the parcel record before you assume whose Register and Trustee you will be dealing with.
Westmoreland
A town of 2,879 on the Kentucky line by the 2025 estimate, with its own water, trash and sewer service. Its 37186 ZIP code reaches into Macon County too, so confirm from the parcel record that the land is in Sumner.
Mitchellville
221 people by the 2025 estimate, close to where Sumner, Robertson and Simpson County, Kentucky, come together. Check both the county and the state the parcel record names.
Castalian Springs
An unincorporated community with its own Design Review Committee. The county's historic-overlay review covers only commercial and multi-family buildings inside the mapped district, so a single-family house follows ordinary county zoning. The 37031 ZIP crosses into Trousdale County; go by the parcel, not the envelope.
Bethpage, Cottontown and the rural county
Bethpage, Cottontown, Shackle Island and the other unincorporated communities answer to the county: county zoning, a state septic permit and a single tax bill from the Sumner Trustee. Bethpage's 37022 ZIP reaches into Macon and Trousdale counties and Cottontown's 37048 into Robertson, so a rural route address settles nothing about which county you are buying in.

Is my Sumner County address in a city or the unincorporated county?
The mailing address will not tell you. Search the parcel in the county's property search; the record shows whether it falls inside one of the eight cities and towns. Even people who live there are unsure - 118 said so in the county's 2025 land-use survey. Inside a city, that city's zoning and tax bill apply; outside, county planning in Gallatin decides what the lot can be. ‡‡‡‡
Who issues building permits and septic permits in unincorporated Sumner County?
Sumner County Building and Codes, on North Belvedere Drive in Gallatin, issues building permits for land outside the cities once county planning has confirmed the zoning. Septic permits are the state's: the county office points you to the Tennessee Department of Environment and Conservation. A lot starred as critical on its plat needs the County Engineer's approval of a plan before construction begins. Line all three up before you buy land to build on. ‡‡‡
Does Sumner County's Adequate Facilities Tax apply outside city limits?
Yes. The 1999 private act behind it names the cities lying in Sumner County, and the county's application form lists all eight cities and towns along with the unincorporated county. New residential space owes 70 cents a square foot when the building permit issues. Additions to an existing single-family home, agricultural barns and rebuilding after a fire or other disaster are exempt; a guest house in the county is not. Buying land to build on? Put the tax in the budget before you sign. ‡‡‡
Can you build on a Sumner County lot with easement access?
It depends on when the lot was made. A lot already on record that reaches a public road by an easement can keep that access, though only one tract may use the easement. A newly created lot must front a public street for at least 50 feet, and an easement does not count; tracts of five acres or more are the exception. Ask county planning about the exact parcel before you sign, and have Vanderpool Law read the easement itself. ‡
Can you rent out a guest house or ADU in unincorporated Sumner County?
Not one permitted as an accessory dwelling outside the cities. The county zoning resolution makes the owner live in one of the two units, keeps the second for family or guests and forbids renting or leasing it, and a covenant saying so goes on record with the Register. Look for that covenant in the title work while you can still walk away. ‡‡
What school district is a Sumner County address zoned for?
Sumner County Schools runs 53 schools, and its online finder gives the school zone and bus route for an exact address. Portland, Millersville and White House each reach across into Robertson County, and Robertson County Schools keeps its own zoning map. On a house in one of those towns, check the address with both districts before you sign - the street address, not the subdivision name. ‡‡‡
The seller picked the title company. Can my own closing attorney still close a Sumner County purchase?
The Tennessee REALTORS Purchase and Sale Agreement leaves one blank for the buyer's closing agency and another for the seller's, so the seller's pick fills only the seller's blank. Your deed is recorded at the Sumner Register in Gallatin either way.
