Living trusts and estate planning · Pleasant View, Cheatham County

New to town, new to the house: when a Pleasant View parent dies, the house goes to probate in Ashland City. A revocable living trust passes it at the kitchen table.

Cheatham County has no separate probate court. Probate is one of the Chancery Court's duties, handled through the Clerk and Master at 100 Public Square in Ashland City, ten miles down Highway 49 from Pleasant View. For the family it means a probate attorney, court costs, a public file anyone can read, and at least four months of waiting that the law requires for creditors, while the house sits in the name of someone who has died and nobody can sell it. A funded revocable living trust moves the house by deed to the people you name, with no case in Ashland City at all.

In short: A will does not keep a Pleasant View house out of probate; it sends the house to the Chancery Court in Ashland City with a public file attached. A funded revocable living trust passes the house by deed to the people you name, with no case and no file. The same plan names who manages your affairs and your care if you cannot, so nobody petitions a court for that either. Vanderpool Law prepares the trust, the pour-over will, the durable and healthcare powers of attorney and the deed, and records the deed at the Cheatham County Register of Deeds on Frey Street in Ashland City, or in Springfield for a Robertson County parcel. One flat fee, quoted in writing after thirty minutes that cost nothing.

A living trust for a Pleasant View family

Half of Pleasant View is new to the house. The Census counts 524 homes in the city built in the 2000s, 343 in the 2010s and 124 since 2020, out of about 2,000, and the town grew from 4,807 people at the 2020 count to an estimated 5,629 by the middle of 2024. The mayor says the town had 800 approved lots waiting to be built when he took office, and the people filling them are, in a longtime resident's words, more and more from out of county and out of state. They bought the house, set up the utilities, found the schools on Old Clarksville Pike, and never got to the part where they wrote down what happens to it. Then a parent dies. The deed is in that parent's name, the mortgage statement keeps arriving, and the family learns that the house cannot be sold, refinanced or even put in the survivor's name until the Chancery Court in Ashland City says so. They make that drive down Highway 49 for months, in the worst months of their lives.

What a Pleasant View family owns is mostly one thing: the house. In Derby Meadows or at Highland Reserves, it is a house under recorded covenants with an association behind them, and the trust has to be written so the trustee can deal with the association the day it matters. On the Robertson County side of ZIP 37146, the same Pleasant View address means a deed recorded in Springfield and, without a plan, a probate case in the Chancery Court there instead of Ashland City; we look the parcel up before the first page is drawn, because a deed into a trust recorded in the wrong county holds nothing. On the county land past the city limits, the house sits on a state-permitted septic system and the acreage may be on greenbelt, and the trust should say so, because the greenbelt assessment survives a deed into your own revocable trust when it is done right. The median sale here was about $380,000 for the three months ending June 2026. That is the inheritance. A trust is how it arrives whole.

Vanderpool Law is in Franklin, about fifty minutes away by I-24 and I-65 to Seaboard Lane in Cool Springs, and the first conversation is thirty minutes, by phone or in person, at no charge. Bring the deed and any will or trust you already have; we read them, complimentary, and tell you what you need and what it costs, in writing, before you decide anything. Nobody has to make the drive to sign: in most cases the papers are signed by remote online notary, or a mobile notary comes to you in Pleasant View. The deed into the trust records at the Cheatham County Register of Deeds, 354 Frey Street, Suite C in Ashland City, or at the Robertson County Register in Springfield for a parcel across the line, and we record it ourselves the week you sign. If the price is the thing standing in the way, say so: for a family going through a rough time, in certain situations, there is a trust scholarship.

Questions Pleasant View families ask about trusts

The questions Google shows for living trust searches in Cheatham County, answered here for Pleasant View, where the house is usually new and the plan usually is not. The full answer is one click away on each.

What happens if you die without a will in Tennessee?

The state's own plan takes over. A Pleasant View house in one name alone goes to the Chancery Court in Ashland City, an administrator is appointed, creditors get their four months, and the statute decides who inherits: a spouse and grown sons or daughters split it by formula, whether or not that is what you wanted. The house cannot be sold until the court is done. A trust replaces that formula with your own instructions and skips the court.

Does a will avoid probate in Tennessee?

No. A will is the document the Chancery Court reads; it starts probate rather than preventing it. For a Pleasant View family that means filing in Ashland City, paying a probate attorney and court costs, and waiting at least four months by law before the house can change hands, with the will and the inventory in a public file. A will still belongs in the plan, as the pour-over backstop behind the trust, but the trust is what keeps the house out of court.

How do I put my house into a trust in Tennessee?

By a deed from you to yourself as trustee, recorded at the Register of Deeds for the county the house is in: Frey Street in Ashland City for a Cheatham parcel, Springfield for the Robertson County side of 37146. The deed into your own revocable trust is exempt from the state transfer tax, your mortgage is unaffected, and a greenbelt assessment on county acreage survives the transfer when the paperwork is done right. Vanderpool Law draws the deed with the trust and records it the week you sign.

Can I put my house in a trust and still live in it?

Yes. You are the trustee of your own revocable trust, you live in the house exactly as before, you can sell it or refinance it, and you can change or revoke the trust whenever you like. Nothing about your Derby Meadows mortgage or your association dues changes. What changes is the day you die: the person you named steps in as trustee and signs, instead of your family asking the Chancery Court in Ashland City for permission.

Who needs a durable power of attorney?

Anyone who owns a house and would rather pick the person who manages it than have a court pick one. A stroke or a long illness leaves a Pleasant View house with an owner who cannot sign, and without a durable power of attorney the family petitions the Chancery Court in Ashland City for a conservatorship before the mortgage can be dealt with or the house sold. The power of attorney, drawn with the trust, names that person now.

How much does a living trust cost in Tennessee?

One flat fee for the whole package: the trust, the pour-over will, the durable and healthcare powers of attorney and the deed into the trust, quoted in writing after a thirty-minute conversation that costs nothing. A Pleasant View plan with one house in Cheatham County is one deed; a plan with a second parcel across the Robertson line is two, and the quote says so before you decide. Nothing is added later.
