Living trusts and estate planning · Mount Pleasant, Maury County

When the parent on the deed dies, the house a Mount Pleasant family has kept since the phosphate days goes to the court in Columbia. A revocable living trust keeps it home.

Maury County has no separate probate court. After a death, the estate is opened in the Chancery Court through the Clerk and Master, whose office with its probate deputy clerk is at 1115 South Main Street in Columbia, up Highway 43 from Mount Pleasant. Probate means a probate attorney, court costs, a file anyone can read, and at least four months by law for creditors before the estate can close, and until it closes nobody can sell the house or sign for it. A revocable living trust holds the house now, so when you die it passes to the people you named, and nobody opens a case in Columbia.

In short: A will does not keep a Mount Pleasant family out of probate; it tells the Chancery Court in Columbia what you wanted, and the court does the rest, in public, over months. A funded revocable living trust passes the house by deed to the people you name, with no case in Columbia and no public file. The powers of attorney drawn beside it say who decides for you if you cannot. Vanderpool Law prepares the trust, the pour-over will, the durable and healthcare powers of attorney and the deed, and records the deed at the Maury County Register of Deeds on the Public Square in Columbia. One flat fee, quoted in writing after thirty minutes that cost nothing.

A living trust for a Mount Pleasant family

Mount Pleasant was a phosphate town. The rock was found here in the 1890s, the population went from 466 in 1890 to about 2,000 by 1900, the mining and the chemical plants ran into the second half of the twentieth century, and the last phosphorus furnace shut in 1971. The families stayed. The houses on North Main Street and in the Pleasant district, both on the National Register since 1989, and the farms past the city limits have been handed down, often with the deed still in one name: the parent's. When that parent dies, the grief comes first, and then the paperwork. The house cannot be sold, rented or signed for until the Chancery Court in Columbia says who owns it, through a case a probate attorney files with the Clerk and Master, that costs money, that anyone can read, and that by law stays open at least four months for creditors. In a town of 5,103 people, that is months of driving to the county seat to settle what a parent could have settled at the kitchen table.

The Mount Pleasant estate is usually one of three things, and the trust has to be drawn for the one you have. The first is the old house in town. If it is on the Downtown Historic Overlay's property list, the Certificate of Appropriateness follows the house, not the owner, so whoever inherits it inherits the design guidelines too, and the trust should name a trustee who can live with them. The second is land. A tract of 15 acres or more may sit on greenbelt, with a rollback of three years of tax savings waiting if a sale disqualifies it, so the trust should say who keeps farming it. The third is the house that is not in Maury County at all: the 38474 ZIP reaches into Lewis, Giles and Lawrence Counties, and the deed records, and the estate opens, where the land actually sits. Inside the city a house gets two tax bills, and the median value owners put on their own homes was $244,400 in the latest Census survey. A probate case is a slow way to pass any of it on.

Vanderpool Law is in Franklin, about fifty minutes from Mount Pleasant by I-65 or US 31 to Columbia and then Highway 43, and the first conversation is thirty minutes, by phone or in person, at no charge. Bring the deed, and any will or trust already in the family; we read them, complimentary, and tell you whether an old estate has to be opened before a trust can take the house, and what the whole plan costs, in writing, before you decide anything. The deed into the trust records at the Maury County Register of Deeds, John Fleming, 1 Public Square, Room 108, Columbia, where we record our Maury closings. The papers can be signed by remote online notary in most cases, or by a mobile notary, so nobody has to drive to Franklin. If the price is the thing standing in the way, say so: for a family going through a rough time, in certain situations, there is a trust scholarship.

Questions Mount Pleasant families ask about trusts

The questions Google shows for living trust and probate searches in Tennessee, answered here for Mount Pleasant, where the house has often been in the family longer than the deed admits. The full answer is one click away on each.

Does a will avoid probate in Tennessee?

No. A will is the document the Chancery Court in Columbia reads to decide who gets the Mount Pleasant house; it is the start of the case, not a way around it. The will still has to be filed with the Clerk and Master, the creditors still get their four months, and the file is still public. What avoids probate is owning the house in a way that already has somewhere to go when you die, and for a house in one name that means a funded revocable living trust.

What happens if you die without a will in Tennessee?

The state's plan takes over. A Mount Pleasant house in one name alone goes to the Chancery Court in Columbia, and the statute, not the family, decides who inherits it, which is how a house on North Main ends up with four owners who cannot agree on a roof. The small-estate shortcut does not apply to any estate that owns real property, so there is no quick version. A trust, or at least a will, says what you meant.

How do I put my house into a trust in Tennessee?

By a deed from you to yourself as trustee, drawn from the current record and recorded at the Maury County Register of Deeds on the Public Square in Columbia, or at the Register of whichever county the land is in if the 38474 address turns out to be across the county line. The transfer is exempt from the state transfer tax. We draw the deed, check that the legal description still matches the parcel, and record it ourselves; a trust nobody deeded the house into holds nothing.

Can I put my house in a trust and still live in it?

Yes. With a revocable living trust you are the trustee while you are alive, you live in the house, you sell it or borrow against it if you want, and you can change or cancel the trust at any time. The city's water, sewer, gas and trash service stays in your name, the overlay rules stay the same, and the tax bills come as before. The only thing that changes is what happens the day you die: the house passes to the person you named, with no case in Columbia.

How much does a living trust cost in Tennessee?

One flat fee for the whole package, the trust, the pour-over will, the durable and healthcare powers of attorney and the deed into the trust, quoted in writing after a thirty-minute conversation that costs nothing. A Mount Pleasant plan with a house in town and a tract on greenbelt is two deeds, and the quote says so before you decide. Nothing is added later.

Who needs a durable power of attorney?

Anyone who owns something and might one day be unable to sign for it, which in Mount Pleasant is the parent whose name is on the deed. A durable power of attorney names who can sell the house, deal with the city over the utility account and handle the bank if you cannot; without it, nobody can sign for you until a court in Columbia says who may. We draw it beside the trust, with the authority over land written in plainly so a bank cannot refuse it.
