Living trusts and estate planning · Chapel Hill, Marshall County

You can't spare your family the grief of losing you. A revocable living trust spares a Chapel Hill family the drive to Lewisburg for probate afterward.

Probate is the state's plan for people who didn't make one, and it runs like any government process: forms, filings, a hearing calendar, and a line. For Chapel Hill that line is at the Marshall County Chancery Court in Lewisburg, twenty minutes south, with a probate attorney, court costs, a public file and at least four months by law before the estate closes. Most Chapel Hill estates are a house and a few acres in one name, which is exactly what sends a family there. A revocable living trust passes them without a case.

In short: Marshall County has no separate probate court. Its Chancery Court in Lewisburg has exclusive jurisdiction over estates, and the Clerk and Master there issues the letters that let anyone sign for a Chapel Hill house in one name, after a wait and a public file. A funded revocable living trust passes the house to your family by deed instead. In the old town, where a plat drawn a century ago can sit under the lot, the deed into the trust has to describe the land the way the Register in Lewisburg has it, so we start from a survey. Vanderpool Law, forty-five minutes up I-65 in Franklin, draws the plan and records the deed, for one flat fee quoted in writing after thirty minutes that cost nothing.

A living trust for a Chapel Hill family

Marshall County has no separate probate court: its Chancery Court has exclusive jurisdiction over probate of estates and conservatorships, and the Clerk and Master in Lewisburg issues letters testamentary and of administration and reviews the accounts. A Chapel Hill family's house, then, passes through a courtroom on the Lewisburg square unless a plan keeps it out.

Chapel Hill is 1,700 people inside the town limits and growing at the edges, and the estates come in two kinds. In the old town on Depot and Maple, a house can sit on a plat drawn more than a century ago, and the town has already granted a variance where an old deed and a new survey drew different lines. A trust that describes that lot from the old deed holds the wrong land; we draw the deed into the trust from a current survey. At the edges, The Groves, Ellington and Spring Creek Farms are new subdivisions where plats were still being approved, deferred and reconsidered through 2026, and a house on an unrecorded plat is a promise the trust cannot hold until the plat records. Past the town, toward Henry Horton State Park and the Duck River, the estate is land and a farm, and what a trust decides there is who gets it and whether the heirs can agree to sell.

Vanderpool Law is in Franklin, about forty-five minutes by I-65 and Highway 99 to Seaboard Lane, and the first conversation is thirty minutes, by phone or in person, at no charge. Bring the deed and any survey; in Chapel Hill the survey is the document that matters. You leave with a plain-English summary and a fee in writing, before you decide. The deed into the trust records with the Marshall County Register at the courthouse annex in Lewisburg, where we record our Marshall closings. If the price is the thing standing in the way, say so: for a family going through a rough time, in certain situations, there is a trust scholarship.

Questions Chapel Hill families ask about trusts

Is it wise to put my house in a living trust?

In Chapel Hill it is the only way to keep the house out of the Chancery Court in Lewisburg, since Tennessee has no transfer-on-death deed. The one thing to do first is get the land described correctly: a house on a Depot Street lot platted a century ago needs the deed into the trust drawn from a survey, not copied from the old deed, or the trust holds the wrong lines.

What is cheaper than a living trust?

A beneficiary form for the accounts, which is free, and survivorship with a spouse for the house, which is a deed. Those carry most of a Chapel Hill estate. What they cannot carry is a house or a farm in one name, and for that the cheaper document, a will, costs the family a Chancery Court case in Lewisburg later. The trust is the cheaper thing when you count both ends.

How much does a living trust cost in Tennessee?

One flat fee for the trust, the pour-over will, both powers of attorney and the deed into the trust, quoted in writing after a thirty-minute conversation that costs nothing. A Chapel Hill plan that needs a survey first says so in the quote. Nothing is added after.

Does a wife automatically inherit everything?

Only what carries her name. A Chapel Hill house held as tenants by the entirety is hers; the farm in her husband's name alone goes to the Chancery Court and then, with children and no will, is split by statute, a child's share or one-third to her. In farm families that split is how land ends up owned by five people who cannot agree. A trust or a will says what he meant.

Do you have to go through probate when someone dies in Tennessee?

Not for what already has a place to go: survivorship property, accounts with beneficiaries, anything in a funded trust. For a house or land in one name alone, yes, in Lewisburg, and the small-estate shortcut Tennessee offers does not apply to any estate that owns real property. A farm is never a small estate.
