Living trusts and estate planning · Watertown, Wilson County

When the parent on the deed dies, the Watertown farm comes back from probate in Lebanon owned by every heir at once. A revocable living trust leaves one person who can sign.

Probate for a Watertown family means the Wilson County Probate Court at 134 South College Street in Lebanon, a division of the county's General Sessions Court with the Clerk and Master as its clerk. An estate there means a probate attorney, court costs, a public file, and at least four months of waiting the law requires for creditors before anything can be settled. A farm or a building on the square left by will to four heirs comes out of it with four owners and nobody able to sign a deed alone. A revocable living trust names one trustee, and the land never goes to court at all.

In short: A will does not keep a Watertown farm out of probate; it sends the farm to the Wilson County Probate Court on South College Street in Lebanon, in public, before anyone can sell or lease an acre of it. A funded revocable living trust passes the land by deed to the people you name, with one trustee who can sign, no case in Lebanon and no public file. The durable and healthcare powers of attorney drawn with it name who decides for you if you cannot. Vanderpool Law prepares the trust, the pour-over will, both powers of attorney and the deed into the trust, and records that deed at the Wilson County Register of Deeds in the courthouse on East Main Street in Lebanon, or in Carthage for the Smith County corner of the ZIP. One flat fee, quoted in writing after thirty minutes that cost nothing.

A living trust for a Watertown family

Watertown is 1,691 people inside a city of 1.4 square miles, and a ZIP code of about 110 square miles around it that takes in Greenvale, Norene, Statesville and a corner of Smith County. The estate here is the ground. It is a farm out Sparta Pike that a grandfather bought and a parent kept, in greenbelt, on a septic system, with the deed still in that parent's name. Or it is a brick building on the square, one of the blocks rebuilt after the 1903 fire, with the store downstairs and the apartment up. When that parent dies, the deed does not know it. The land goes to the Wilson County Probate Court in Lebanon, where a probate attorney opens the estate, the file is public, and the law holds everything for at least four months while creditors are given their chance. What comes out the other side, if the will said to the heirs equally, is a farm with four owners, every one of whom has to sign before a single acre can be sold, and families here have learned what that silence between brothers and sisters costs.

A revocable living trust meets each of Watertown's particulars. A farm in greenbelt stays in greenbelt while it stays a farm of at least 15 acres in use; the rollback, three years of the tax savings, comes due when the use changes, so the trust should say the farm stays a farm and name the one trustee who may lease or sell it. A building on the square comes with the city's historic overlay, and any change to its front takes a Certificate of Appropriateness from the Historic Preservation Commission; the trustee who inherits it should know that before the first contractor calls. A house past the city's sewer lines drains to a septic system whose permit record the trustee will need the week the house is sold. And the Smith County corner of the ZIP records its deeds in Carthage, not Lebanon, so a trust funded with a deed recorded in the wrong courthouse holds nothing; we look up the parcel first. The deed into your own revocable trust is exempt from the state transfer tax, and e-filed at the Register it can be recorded in minutes.

Vanderpool Law is in Franklin, about an hour and ten minutes from Watertown, around I-840 to I-40 and out Highway 70, and most of our Wilson County work begins by phone. The first conversation is thirty minutes, by phone or in person, at no charge. Bring the deed, the survey if there is one, and any will or trust you already have; we read them, complimentary, and tell you what you need and what it costs, in writing, before you decide. The papers can be signed by remote online notary in most cases, or by a mobile notary at your own kitchen table, so nobody has to drive to Franklin. The deed into the trust records at the Wilson County Register of Deeds, Room 108 of the courthouse at 228 East Main Street in Lebanon, or at the Smith County Register in Carthage for a parcel across that line. If the price is the thing standing in the way, say so: for a family going through a rough time, in certain situations, there is a trust scholarship.

How much does a living trust cost in Tennessee?

One flat fee for the whole package: the revocable living trust, the pour-over will, the durable and healthcare powers of attorney, and the deed that moves the farm or the building on the square into the trust, recorded at the Register in Lebanon. It is quoted in writing after a thirty-minute conversation that costs nothing, and nothing is added later. A Watertown plan with a farm on Sparta Pike and a parcel across the Smith County line is two deeds in two courthouses, and the quote says so before you decide.

What is the difference between a will and a living trust?

In Watertown the difference is the drive to South College Street. A will is instructions for the Probate Court in Lebanon: it names who handles the estate, and then the court, a probate attorney, a public file and at least four months by law do the rest, and the farm comes out owned by everyone named. A funded revocable living trust is a deed already recorded and one trustee already named, so there is nothing for the court to do. The pour-over will comes along behind the trust as the backstop for anything left out.

How do I put my house into a trust in Tennessee?

By a deed from you to yourself as trustee, drawn from the legal description the Register has on file and recorded at the Wilson County Register of Deeds in Room 108 of the courthouse on East Main Street in Lebanon; e-filed, it can be on record in minutes. For a farm we draw it from the survey, so the tract the trust holds is the tract the family means. A parcel in the Smith County corner of the ZIP records in Carthage instead. The deed into your own revocable trust is exempt from the state transfer tax, and the greenbelt farm stays a greenbelt farm.

What happens if you die without a will in Tennessee?

Tennessee has a plan for you, and for a Watertown farm it runs through the Probate Court in Lebanon: the state's rules, not your wishes, decide who gets the land, the court decides who handles it, and the small-estate shortcut is closed because the estate holds real property. The farm comes out owned by every heir the statute names, in equal shares, with no one able to lease it or sell it alone. A will fixes who; only a funded revocable living trust fixes the court.

Can I put my house in a trust and still live in it?

Yes. You are the trustee of your own revocable living trust, so you live on the farm, farm it, lease the back field, refinance the building on the square or sell any of it, exactly as before, and you can change the trust or take the land back out any day you like. The greenbelt classification, the septic permit and the historic overlay on the square all stay what they were. The only thing that changes is the day you die, when the successor trustee signs instead of the Probate Court in Lebanon.

Who needs a durable power of attorney?

Anyone who owns land in one name, which in Watertown is most of the farms. If you are alive but cannot sign, a will does nothing and the trust only covers what is in it; the durable power of attorney is what lets the person you chose lease the hay ground, deal with the Assessor over greenbelt, or sell the building on the square without a conservatorship case on South College Street first. We draw it with the trust, and we write in the land powers a generic form leaves out, which is why so many of those get refused.
