Living trusts and estate planning · Portland, Sumner County

When the parent on the deed dies, a Portland family spends months driving to probate court in Gallatin to keep the house. A revocable living trust keeps it in Portland, no case.

Sumner County has no separate probate court. An estate is opened in the Chancery Court, through the Clerk and Master at the Sumner County Courthouse, 155 East Main Street in Gallatin, down Highway 109 from Portland. For the family that means a probate attorney, court costs, a file anyone can read, and at least four months of waiting that the law requires for creditors, and since 2023 an in-person probate hearing needs the Chancellor's permission first. A funded revocable living trust moves the house by deed to the people you chose, and nobody opens a case in Gallatin at all.

In short: In Sumner County a will is a filing, not a plan: the Portland house goes to the Chancery Court in Gallatin, with a probate attorney, court costs and a public record, before anyone can sell it or keep it. A revocable living trust that holds the deed needs none of that; the person you named signs for the house the week you die. The same plan names who handles your money and your medical decisions if you cannot. Vanderpool Law draws the trust, the pour-over will, both powers of attorney and the deed, then records the deed at the Sumner County Register of Deeds on North Belvedere Drive in Gallatin, or in Springfield for the Robertson County corner of town. One flat fee, in writing, after thirty minutes that cost nothing.

A living trust for a Portland family

Portland is the town families drove up Highway 109 to for room and a new house: 13,658 people on the 2025 Census estimate, up from 13,156 in 2020, in subdivisions the city approves by the plat, Richland Estates at North Russell Street and Victor Reiter Parkway, Bracken Estates on North Harris Lane, Grandview Estates on Fowler Ford Road, and the ones the city's own dashboard lists by name, Jetton Farms, Village Green, Magnolia Springs, Parkside Point, Deer Run, Vail Crest. For most of them the house is the whole estate. Sumner County has no separate probate court; an estate is opened in the Chancery Court through the Clerk and Master at 155 East Main Street in Gallatin. When the parent whose name is on the deed dies with no plan, the family learns that the house cannot be sold, refinanced or put in anyone else's name until that court says so, and the saying so takes a probate attorney, court costs, a public file and at least four months by law for creditors. They make the drive down 109 again and again, in the hardest months they will have.

What a Portland family owns is a house worth about $329,771 on Zillow's September 2026 index, often under recorded covenants with an association behind them, because a planned unit development here keeps a fifth of its ground as open space that somebody has to own; the trust names who answers for it. The deed also has to reach the right courthouse: the Census Bureau counts a corner of Portland in Robertson County and the 37148 ZIP code crosses the line, so a parcel on that side records in Springfield and, with no plan, its estate opens in the Chancery Court there instead. We pull the parcel before we draw anything; a deed recorded at the wrong Register puts nothing into the trust. West of Broadway, the Highway 109 bypass is taking right of way on a 250-foot strip, and a trust leaves one trustee able to answer the state's letter if it comes after the owner is gone. On county land past the city limits, the house sits on a state septic permit and the acreage may be on greenbelt; both carry over into your own revocable trust.

Vanderpool Law is in Franklin, about an hour and ten minutes south by I-65 from Exit 117 to Seaboard Lane in Cool Springs, and nobody in Portland has to make that drive. Thirty minutes, on the phone or across the desk, costs nothing. Bring the deed and whatever will or trust you already have; reading them is complimentary, and you get the price in writing before you say yes to anything. Signing does not require the drive either: a remote online notary handles it in most cases, and a mobile notary can come to Portland otherwise. The deed into the trust records at the Sumner County Register of Deeds, 355 North Belvedere Drive, Suite 201 in Gallatin, or at the Robertson County Register on South Brown Street in Springfield for a parcel on that side, and the recording is ours to handle. If the price is the thing standing in the way, say so: for a family going through a rough time, in certain situations, there is a trust scholarship.

Questions Portland families ask about trusts

The questions Google shows for living trust searches in Sumner County, answered here for Portland, where the estate is usually a new house and the court is in Gallatin. The full answer sits one click away on each.

What is the difference between a will and a living trust?

A will is instructions for the Chancery Court in Gallatin: it tells the Clerk and Master who gets the Portland house, and the court supervises the handing over, in public, for at least four months. A living trust is instructions for a person: the trustee you named already holds the deed and follows the trust the week you die, with no court in it. For a Portland family whose estate is the house, that difference is the whole point. A pour-over will still rides along as the backstop for anything left outside the trust.

Does a will avoid probate in Tennessee?

No. A will is how an estate gets into probate in an orderly way, not how it stays out. For a house in Richland Estates or Bracken Estates in one name alone, a will means a case in the Sumner County Chancery Court, a public file in Gallatin and a wait of at least four months by law before the house can be sold or put in anyone else's name. Tennessee has no transfer-on-death deed, and the small-estate route is closed to any estate that owns real property, so the only paper that keeps a Portland house out of court is a deed into a funded revocable living trust.

How do I put my house into a trust in Tennessee?

By a deed you sign as the owner to yourself as the trustee, drawn to match the description the Register already has for the lot, and recorded at the Sumner County Register of Deeds on North Belvedere Drive in Gallatin, or in Springfield if the parcel sits on Portland's Robertson County corner. The transfer is exempt from the state transfer tax. The association in a planned unit development deals with the trustee as it dealt with you, and a greenbelt assessment on county acreage carries over. Vanderpool Law draws the deed and records it rather than handing you instructions.

What is a healthcare power of attorney?

The document that names who speaks to the doctors for you if you cannot, and says what you want them to say. It comes with the trust, alongside the durable power of attorney for money and property. Without it, a Portland spouse or grown son or daughter who has to make a decision at the hospital can be told to petition the Chancery Court in Gallatin for a conservatorship first, with a lawyer, a hearing and a public file, in the worst week of the year. Naming the person now takes a page.

How much does it cost to set up a living trust in Tennessee?

One flat fee for the whole package: the trust, the pour-over will, the durable and healthcare powers of attorney and the deed into the trust, quoted in writing once we have talked for thirty minutes at no charge. A Portland plan with a house in town and acreage past the city limits is two deeds, and the quote says so before you decide. Nothing is added later.

What happens if you die without a will in Tennessee?

Tennessee has a plan for you, and it runs through the Chancery Court in Gallatin: the state's own list of heirs decides who gets the Portland house, a probate attorney and the court supervise the handing over, and the file is public. The small-estate shortcut is closed because the estate owns real property. A house in a funded revocable living trust skips all of that and goes to the people the trust names, and the same plan says who steps in if you are alive but cannot sign.
